EatSmart Terms of Service

1. Acceptance of Terms

By accessing or using the EatSmart mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

EatSmart is a content creator platform that connects users with marketing materials and earning opportunities. The App allows you to:

Download marketing materials (videos and images)
Access brand content for promotional purposes
Track your download history and activity

3. Account Registration

To use EatSmart, you must create an account using one of the following methods:

Google Sign-In
Apple Sign-In
Phone Number (via SMS verification)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Account Deletion

Important Information About Account Deletion:

You may delete your account at any time through the App settings. When you delete your account:

All login methods (Google, Apple ID, Phone) are permanently removed
Your personal information (name, email, phone number, profile picture) is permanently deleted
Your account cannot be recovered or restored
Historical usage data is anonymized using cryptographic hashing and cannot be linked back to you
If you create a new account, it will start fresh with no access to previous data

The deletion process is immediate and irreversible.

5. Data Collection and Usage

We collect and use the following information:

Login Information: Email, phone number, and authentication tokens from Google, Apple, or Firebase
Profile Information: Name, profile picture (if provided by your login method)
Usage Data: Download history, materials accessed, and app activity
Device Information: Device type, operating system, and app version for authentication and support

This data is used to provide and improve our services, authenticate your identity, and track your activity within the App. For more details, please see our Privacy Policy.

6. User Conduct

You agree not to:

Use the App for any illegal or unauthorized purpose
Violate any laws in your jurisdiction
Infringe upon the rights of others
Attempt to gain unauthorized access to the App or its related systems
Distribute malware or other harmful code

7. Intellectual Property

All content provided through the App, including but not limited to videos, images, text, and graphics, is the property of EatSmart or its content suppliers and is protected by copyright and other intellectual property laws.

Materials downloaded through the App are provided for promotional purposes only and must be used in accordance with any additional guidelines provided by the content owners.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EATSMART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date" above. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EatSmart operates, without regard to its conflict of law provisions.
